The content of these files must have been created in earlier commits of this session, such as the start commit e5771717 or the probe commits, whose diffs are not in the pack. The prior results also show the probes first reported backend/AGENTS.md and frontend/AGENTS.md as missing, then as existing, which is consistent with in-session iteration. Nothing in the visible evidence shows the setup pre-dated the session, so no penalty is substantiated.
